Terms and Conditions

Metabolt operates through two companies:

• METABOLT FZCO, a free zone company registered in the Dubai Multi Commodities Centre, License no. DMCC-1041180, Unit 30-01-5305, DMCC Business Centre, Level 1, Jewellery & Gemplex 3, Dubai, United Arab Emirates.
• METABOLT, Inc., a Delaware corporation, Company no. 10796889, 2810 N Church St, STE 90763, Wilmington, DE 19802, United States.

Where you are located in the United States, METABOLT, Inc. is the company responsible for your information and your use of the services. Everywhere else, METABOLT FZCO is responsible. In these documents, “Metabolt”, “we” and “us” mean the company responsible for you.

By using metabolt.com or any Metabolt service you agree to these terms. If you use the services on behalf of an organisation, you confirm you are authorised to accept them for it. Specific services, such as membership plans or clinic programmes, may have additional terms that we will show you before you sign up.

Metabolt is a metabolic intelligence platform. It observes the signals you connect, infers a live physiological state, projects its likely trajectory with a stated confidence, and recommends one of a small set of actions. Some services are offered in stages and may not be available in your country yet. We may change, suspend or discontinue features, and will give reasonable notice where a change materially affects you.

Metabolt provides metabolic decision support. It does not diagnose, treat or prescribe. Always consult your clinician before changing therapy.

• Recommendations are decision support, not prescriptions, diagnoses or treatment plans. Projections are estimates with a stated confidence, and can be wrong.
• Metabolt complements clinical care. It does not replace your clinician, and it is not an emergency service.
• If you feel unwell, have symptoms of very low or very high glucose, or are in doubt, follow the plan agreed with your clinician and contact emergency services where appropriate.
• Metabolt is pursuing a clinical decision support regulatory pathway. Until any clearance is granted in your country, the services are not offered as a medical device there.

You must be at least 18 to use the services. You are responsible for keeping your account credentials secure and for the accuracy of the information you provide. Tell us promptly at hello@metabolt.com if you suspect unauthorised use of your account.

You agree not to:

• use the services in a way that breaks the law or harms others;
• access another person's data without their authorisation;
• attempt to reverse engineer, scrape, overload or interfere with the services or their security;
• copy, resell or create derivative products from the services, their models or their outputs;
• present Metabolt recommendations as medical advice from Metabolt to anyone else.

The services can connect to sensors, wearables, labs and other third-party products. Those products are provided by their makers under their own terms. We are not responsible for their availability, accuracy or performance, and readings from them may be delayed, missing or inaccurate.

Where a service is paid, the price, billing period and cancellation terms will be shown before you commit. Unless stated otherwise, prices exclude applicable taxes.

The services, the Metabolt name, monogram and logotype, and all content on this website belong to Metabolt or its licensors. We grant you a limited, personal, non-transferable licence to use the services as intended. Your data remains yours; you grant us the rights needed to process it to provide the services, as described in the Privacy Policy.

To the extent permitted by law, the services are provided “as is” and “as available”. We do not warrant that they will be uninterrupted, error-free, or that any projection or recommendation will be accurate for your circumstances. Nothing in these terms limits rights you have under consumer protection law that cannot be excluded.

To the extent permitted by law, Metabolt is not liable for indirect, incidental, special or consequential losses, or for decisions you make using the services. Our total liability for any claim relating to the services is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you have not paid us. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or where exclusion is not permitted by law.

You can stop using the services and close your account at any time. We may suspend or end access if you breach these terms, if required by law, or to protect members or the services. Sections that by their nature should survive termination will survive it.

If your contract is with METABOLT FZCO, these terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, and disputes will be resolved by the courts of Dubai, unless the law of your country gives you the right to bring a claim locally.

If your contract is with METABOLT, Inc., these terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, and disputes will be resolved by the state or federal courts located in Delaware, unless the law of your state gives you the right to bring a claim locally.

Before starting any formal claim, please contact us at legal@metabolt.com so we can try to resolve it informally.

We may update these terms. For material changes we will give notice through the services or by email before they take effect. Continuing to use the services after that means you accept the updated terms.
